lol. Sure it is, if it looks the same, but my design only has one, ONE simulatiry, and thats the white on top, and black on bottom. You can’t say I’m “copying” just because of that.

The action of viewing and dissecting Derek’s proprietary code (I don’t see Creative Commons rights listed, but there IS a Contact form in the footer) is not the issue. However, pasting it anywhere public-facing crosses the line. I’m sure any designer would be flattered to know that someone is examining his/her coding prowess in an attempt to learn and better themselves…but nobody likes to see their effort of much hard labor paraded around like a new trophy girlfriend.

You are quick to take credit for the design, and do a bang-up job on the ‘color commentary’ overview of the site:

Off the top of my head. I would guess 5ThirtyOne gets a few thousand unique hits each day…I would also guess that at one time or another a good portion have tried to draw some inspiration from Derek’s clean and thorough work. But you don’t see 20 or 30 ‘copycat sites’, do you?

There’s a reason for that – something called PRIDE. My advice: Use a publicly available theme, and pick apart the code as you see fit in your bedroom. When you create something truly yours, show it off!
